1. Introduction
This End User License Agreement (“EULA”) is concluded between you, the purchasing party (“Licensee”), and LIT Create GmbH, which distributes font software under the name Fuego Fonts (“Licensor”). By purchasing, downloading, or using our font software (“Fonts”), you agree to be legally bound by the terms set out in this Agreement. This Agreement is intended exclusively for commercial transactions with business customers (B2B). By accepting this Agreement, the Licensee confirms that they are acting in a professional or commercial capacity and not as a private consumer. If you are acting on behalf of a client, you confirm that the client accepts this Agreement in full. The License is granted only to the end user named in the Order Confirmation.
2. Definitions
The following terms are used in this Agreement:
“Licensee” refers to the individual (including freelancers and self-employed professionals) or legal entity that purchases or otherwise lawfully obtains the License to use the Fonts.
“Licensor” means Fuego Fonts., legally operated by LIT Create GmbH.
“Fonts” are the digital font software provided by the Licensor, including all related files, styles, and formats.
“License” refers to the non-exclusive, non-transferable, perpetual, and worldwide right to use the Fonts under the terms of this Agreement.
“Order Confirmation” refers to the invoice or written confirmation issued by the Licensor that specifies the License type, license metrics, and scope of permitted use.
“Commercial Use” refers to any use of the Fonts related to business, professional, or revenue-generating activities, including client work, promotional materials, or monetized content.
“Non-commercial Use” refers to personal, academic, or cultural uses where no direct or indirect commercial benefit is derived.
“Trial Fonts” means limited versions of the Fonts made available by the Licensor for evaluation and internal testing only. These versions may contain restricted functionality or character sets and are not licensed for commercial or public use.
“Third Party” refers to freelancers, agencies, design studios, developers, or any external collaborators that work for the Licensee.
3. Grant of License / Rights
Upon full payment, the Licensor grants the Licensee a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to use the Font Software under certain terms and conditions. The rights granted under this Agreement are perpetual and apply worldwide, unless otherwise stated.
Each License is strictly limited to the individually selected license types and metrics, as well as brands, domains, applications, platforms, or other specifications as explicitly defined in the order confirmation or invoice. Any use beyond the agreed scope requires a separate license or an appropriate license upgrade.
Any Fuego Fonts products may not be distributed and/or sold to third parties without prior written consent from LIT Create GmbH.
The licenses listed hereinafter are independent from each other, and more than one type of License may be purchased. No rights are granted beyond those expressly set out in this Agreement, unless separately agreed to in writing.
4. Licenses
4.1 Desktop and Print License
This License allows the Licensee to install and use the Fonts on internal devices or user accounts for creating static designs in print and digital media. Permitted uses include, for example, printed matter, packaging, editorial layouts, signage, presentations, and exports like PDFs, JPGs or PNGs.
The License is determined by the total number of staff members of the Licensee at the time of purchase, as defined in the Licensee’s order confirmation. Fonts may be used on your internal devices, provided that the company remains within the licensed size tier and adheres to the specified licensing metrics.
Use of the font by third parties such as freelancers, agencies or contractors is not allowed. Each external party requires their own License.
The Fonts may be used in office and presentation software such as Microsoft Office, Apple Keynote, Google Docs or similar tools, only if installed on internal company devices. Fonts must never be embedded, shared or made accessible to unlicensed users. Editable files may not be shared externally; only non-editable exports such as PDFs are allowed.
The Fonts may not be modified, reverse-engineered, converted into other formats or used with font editing or conversion tools. Embedding the Fonts in websites, apps or other digital environments, or using it in logos or wordmarks is not covered by this license and requires a separate one.
If the organization grows beyond the licensed size tier, the Licensee must obtain an upgrade, i.e. extend the License to.
4.2 Web and Social Media License
This license allows the Licensee to use the Fonts on websites and in visual content created for social media platforms.
The Fonts may be used on websites using standard webfont embedding methods, as long as they are only accessible within the licensed scope. The license is determined by the total monthly pageviews summed up across all websites and domains, as defined in the Licensee’s order confirmation.
This license also permits the creation of static or animated content such as posts, stories, ads or videos for platforms like Instagram, TikTok, Facebook, Twitter/X, LinkedIn or similar. All content must be exported in non-editable formats and may only be published through the Licensee’s own official accounts.
Use by external collaborators such as freelancers, agencies or subcontractors is not permitted. Each party must obtain their own License.
The Fonts may not be embedded in online editors, design tools or other environments where unlicensed users can access or interact with them.
The Fonts may not be modified, reverse-engineered, converted into other formats or used with font editing or conversion tools.
The use in apps, software, logo or print (as mentioned in sections 4.1, 4.3 and 4.4) is not included and requires a separate license. This includes any owned web-based or browser-based applications. For this another license is required. If the Licensee exceeds the licensed pageview tier or social media usage scope, an appropriate upgrade must be obtained.
4.3 App, Software and Game License
This license grants the Licensee the right to embed the Font Software into a mobile application, desktop software or video game developed and distributed by the Licensee. The license applies to a single app or game title. Separate licenses are required for additional titles unless otherwise agreed in writing. Sequels or technical updates of the licensed title are covered.
The License is determined by the number of monthly active users. The Licensee must ensure that usage remains within the licensed tier, as specified in the order confirmation. If the licensed tier is exceeded, the Licensee must obtain an appropriate upgrade. The Fonts must be embedded in a manner that reasonably prevents access, extraction or standalone use by end users.
Distribution through official platforms such as the Apple App Store, Google Play, Steam or console marketplaces is permitted, provided the Font Software is not made available as a standalone file, and all terms of this Agreement are respected.
Use by external collaborators such as freelancers, agencies or subcontractors is not permitted. Each party must obtain their own License.
The Fonts may not be embedded in online editors, design tools or other environments where unlicensed users can access or interact with them.
The Fonts may not be modified, reverse-engineered, converted into other formats or used with font editing or conversion tools. This license does not include any use of the Fonts outside the application itself. A separate license is required for promotional materials, packaging, advertisements, websites, or printed content.
4.4 Logo and Wordmark License
This License grants the Licensee the right to use the Font Software to create a single logo or wordmark as part of their own brand identity. This right applies exclusively to the Licensee’s own brand or sub-brand. It does not extend to third parties or client work. This License does not include general use of the Fonts beyond the logo design. Any other use, including desktop publishing, web, app, packaging or advertising, requires the appropriate license type.
The Fonts may only be used to produce the final logo artwork. The Font Software itself may not be embedded, modified or distributed, except as technically required for the creation of the final design. Logos must be delivered in non-editable formats such as outlines or raster files when shared with external parties. If the Licensee intends to create additional logos or visual identities, a separate License is required for each.
4.5 Trial License
This License allows the Licensee to install and use limited trial versions of the Fonts for evaluation and internal presentation purposes only. The Trial Fonts may include a reduced character set or limited functionality and are provided solely to assess their suitability for future licensing.
The Fonts may be used to create non-commercial mockups, test layouts, client proposals or pitch documents. All content created with Trial Fonts must remain unpublished and may only be shared for internal review or decision-making.
Trial Fonts may be installed on personal or work devices within the Licensee’s organization, provided they are not used for commercial or production work.
This License does not permit the Fonts to be used in any published, printed or distributed materials, or in any client projects, branding, advertising or digital products.
The Fonts may not be embedded in websites, applications or editable templates, nor may they be converted, modified or redistributed in any form. If a project using the Fonts is published, sold, commissioned or otherwise enters commercial use, a full commercial license must be obtained from the Licensor.
4.6 Other Licenses or License Extensions
For any other License or usage types not expressed in this Agreement, the Licensee requires a separate written agreement with the Licensor. This applies to, but is not limited to, the right to use the fonts in audio-visual, film, TV, streaming or broadcasting.
For any additional licenses or extensions, please get in touch via contact@fuegofonts.com. This includes unlimited / all media licenses, as well as customization services of existing retail fonts or fully customized brand fonts.
5. Restrictions
Unless explicitly permitted in writing, the Licensee is not allowed to:
- Share, distribute, resell, rent or sublicense the Font Software in any form.
- Upload the Fonts to public servers, cloud platforms or version control systems.
- Modify, convert, reverse-engineer or create derivative versions of the Font Software.
- Use the Fonts outside the licensed scope, including use by or for other clients, brands, domains, projects or entities not covered by this Agreement.
- Embed desktop font formats (such as OTF or TTF) in web, app or software environments.
- Use the Fonts in online editors, template systems or collaboration tools that allow access or editing by unlicensed third parties.
- Include the Fonts in editable files or templates that can be accessed or reused by third parties without a valid license.
- Use the Fonts to train, develop or feed artificial intelligence systems or datasets.
- Use the Fonts in unlawful, defamatory, discriminatory or hateful content.
Violation of any of these restrictions may result in immediate termination of the License and legal consequences, including claims for damages and removal of the Fonts from all media and systems.
6. Discounted Licenses for Non-Profit and Cultural Institutions
This license is available to registered non-profit organizations, public institutions, museums and independent cultural practitioners who are working in a non-commercial context.
Discounted pricing may be granted upon request and is subject to individual approval by the Licensor. The amount of the discount may vary depending on the type of organization, the nature of the project and the intended use of the Fonts. Eligibility is assessed on a case-by-case basis. The Licensee must provide proof of non-profit status and relevant project information upon request. The Fonts may only be used within the approved scope. Any commercial, promotional or client-related use requires a separate commercial license.
If the actual usage exceeds the licensed scope, or the nature of the project changes, the Licensee must obtain an appropriate license upgrade. We currently do not offer discounted licenses for students.
7. Use by Third Parties
The Font Software may only be used by the Licensee and their directly employed staff. Any third party, including freelancers, agencies, design studios, developers, or external collaborators must obtain a separate license. This applies regardless of whether they are working on the same project or under direct instruction from the Licensee.
Sharing the Fonts with unlicensed parties, even temporarily or for production purposes, is strictly prohibited.
8. Ownership and Intellectual Property
The Font Software, including all copies, modifications and derivative works, remains the sole and exclusive property of the Licensor. This License does not transfer any ownership, copyright or intellectual property rights to the Licensee. The Licensee acquires only the limited, non-exclusive rights of use expressly defined in this Agreement. The underlying typeface design also remains the intellectual property of the Licensor.
9. Warranty and Liability
The Fonts are provided “as is” without any express or implied warranties. The Licensor does not guarantee that the Fonts will meet the Licensee’s requirements, be error-free, or work with all systems or software environments.
To the extent permitted by applicable law, the Licensor shall not be liable for any indirect, incidental, consequential or punitive damages arising from the use or inability to use the Fonts. This includes, but is not limited to, loss of profits, data or business opportunities.
The Licensor’s total liability is limited to the amount paid by the Licensee for the License. Nothing in this Agreement shall limit or exclude liability where such limitation is not permitted by law, including liability for intent or gross negligence.
10. Termination
The License remains valid until terminated. It terminates automatically and without notice if the Licensee breaches any provision of this Agreement. Upon termination, the Licensee must immediately stop using the Fonts and delete all copies, including backups and any embedded files.
The Licensor reserves the right to take legal action to enforce its rights, including but not limited to injunctive relief, claims for damages and reimbursement of legal or enforcement costs.
Termination does not affect any rights or obligations that arose prior to the termination date.
11. Jurisdiction and Governing Law
This Agreement is governed by the laws of the Federal Republic of Germany. The place of jurisdiction is Berlin, Germany, where legally permitted. Mandatory consumer protection laws remain unaffected.
12. Miscellaneous
If any part of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
This Agreement replaces all prior oral or written agreements regarding the Fonts. Any changes or amendments must be made in writing and approved by the Licensor.
